Interview With Screenwriter Sammy Sultan – A number of prominent Indigenous artists, including Briggs, Dan Sultan and Jessica Mauboy, have signed an open letter rejecting proposed changes to Australia’s copyright laws.

In late 2016, the Productivity Commission proposed significant changes to intellectual property laws, including a significant reduction in the term of copyright on creative works (currently 75 years after the author’s death) as well as the introduction of ‘fair use’. “The proposed changes will have a negative impact on the stories, images, knowledge and heritage that are part of our storytelling and artistic works. Ownership is also a way of giving financial power to artists who make money from the sale, resale and reproduction of their work.”

The letter has 42 signatures from six different organizations. Along with Briggs, Sultan and Mauboy, several other musicians have also been signed, including Troy Cassar-Daly, Geena Williams and Dave Arden. The entire list includes writers, directors, artists and curators.

This is not the first criticism of proposed ‘safe harbor’ laws. Last year APRA AMCOS labeled the proposed changes “an unrelenting attack on Australia’s creative industries, which benefit from Australian content and shamelessly promote the interests of those who create it”.

Following the release of a draft report in October last year, a number of musicians including Delta Goodrem, John Furnham, Guy Sebastian and Gotye spoke out against proposals to introduce ‘safe harbor’ laws in Australia, which protect service providers from internet liability. Open Letter: Artists, Musicians, Artists, Filmmakers and Writers From Strategy to Basic and Torres Production, Against the Productivity Commission’s Recommendation Regarding Copyright

Sundance Film Festival: Short Films & Retrospective Titles Announced

We, the undersigned, unanimously reject the Productivity Commission’s recommendations on copyright in Australia. Proposals to change copyright protections will harm the ability of Aboriginal and Torres Strait Islander film and television producers, writers, artists, musicians and journalists to tell Indigenous stories and make a living.

Aboriginal and Torres Strait Islander artists and producers have the right to fair remuneration for their work. Changes to Australia’s copyright laws by the Productivity Commission, large corporations and large technology companies will significantly reduce these protections.

This is not only unfair, it is a threat to the art tribe and could mean that it will be even more difficult for the next generation of artists to make a living. Our children should be able to be inspired by artists like Albert Namatjira and Emily Kame Kangware, listen to the music of artists like Dan Sultan and Jessica Mauboy, and watch movies like Bran New Day and Samson and Delilah, and black comedies and basically shows on television. Briggs, Dan Sultan & More Indigenous Artists Pen Open Letter Against Proposed Copyright Changes

It is imperative that Aboriginal and Torres Strait Islander peoples have ownership, responsibility and control over their cultural heritage. The proposed changes will have a detrimental impact on the stories, images, knowledge and heritage that form part of our storytelling and artefacts.

Ownership is also a way of giving financial power to artists who get paid by selling, reselling and reproducing their works.

We call on the Australian Government and Parliament to scrap these proposed changes from the Productivity Commission.
