BISMARCK, ND (AP) — When the wind howls and the freezing cold sets in, many North Dakotans are happy to break the law by warming up their vehicles without being in them, ignoring a potential $1,500 state fine and 30 days in prison.
“It’s ineffective. People ignore him. Let’s get rid of that,” said Republican Rep. Daniel Johnston, who is sponsoring a bill that would allow people to leave their vehicles unattended, reversing a bill that has been around since the 1940s and that no one remember it was applied.
“Put simply, the law is against the will of the people,” Johnston told the House Transportation Committee on Friday. “The citizens of North Dakota will recognize that this is a bad law.”

The group said idling wastes about 6 billion gallons of fuel a year, and 18 states have grants, loans and tax credits to encourage idling reduction.
Not even the environmental group the Sierra Club is standing in the way of idling being legal. Wayde Schafer, a spokesman for the North Dakota group, said the idling ban is unnecessary in North Dakota, where it’s considered a necessary evil because of brutal winter weather.

“It’s so ingrained in our culture that people will never change their habits, even if they know it’s against the law,” Schafer said. “It’s winter in North Dakota and people want to get into a warm car, so what do you do?”
Bismarck Police Chief Dave Draovitch, who has spent nearly three decades with the department, said leaving idling vehicles unattended is not something officers enforce.
“We’d rather have the vehicles locked,” Draovitch said, adding that leaving vehicles running when empty is a great opportunity for thieves.
Fargo Police spokeswoman Jessica Schindeldecker said most of the vehicles stolen in North Dakota’s largest city happen during the winter, and most are left idling with the doors open.

Schindeldecker didn’t know if anyone had ever been called for idling, but said officers sometimes “talk to the owner and tell them they want to stop doing that.”
Jennifer Wagner of Minot’s car was stolen years ago after she left it running to drop off some belongings at her church. She now runs a business with her husband that installs remote starters that allow the driver to preheat the vehicle before getting into it.
She said most remote starters come with anti-theft systems that do not allow the vehicle to be opened or driven without a key.
“Most people probably don’t even know the law, and even if they do, they don’t care and are willing to take the risk,” she said.

Her company, Too Dark Motorsports, is one of dozens in the state that sells and installs remote starters, which are often booked for two to three weeks in the winter, she said.
